1. Introduction
This Acceptable Use Policy ("AUP") governs your use of IXmail, the email delivery service operated by Innovatex Digital FZCO, a free-zone company registered in IFZA, Dubai Silicon Oasis, United Arab Emirates ("Innovatex," "we," "us," "our").
By creating an account or sending email through IXmail, you ("Customer") agree to follow this AUP. If you operate sub-accounts or send on behalf of others, you are responsible for ensuring those parties also comply with this AUP.
This AUP is incorporated into our Terms of Service. Violations may result in throttling, suspension, or termination of your account, as described in Section 11.
2. Definitions
- Service
- IXmail, including all APIs, SMTP relays, dashboards, and supporting infrastructure.
- Customer
- The legal entity or individual that registered for an IXmail account.
- Recipient
- An end-user mailbox to whom you send email through the Service.
- Bulk Mail
- Any distribution of substantially the same content to more than 100 Recipients within a 24-hour period.
- Transactional Mail
- Email triggered by a Recipient's interaction or relationship (e.g. password reset, order confirmation, account notification).
- Marketing Mail
- Any non-transactional commercial email, including newsletters, promotions, and campaigns.
3. Customer Tiers
To balance accessibility with deliverability, IXmail classifies accounts at signup into one of four tiers based on industry and use case. Tier governs initial sending limits and operational review level.
3.1 Standard Tier
Low historical complaint rates. Auto-approved at signup; standard sending limits apply.
SaaS, e-commerce, B2B notifications, internal HR/IT, education, healthcare (clinic operations), non-profits, real estate, recruiting and staffing, professional services.
3.2 Monitored Tier
Permitted but historically associated with elevated complaint rates. Auto-approved with enhanced monitoring and slower volume increases.
Marketing agencies, lead generation, affiliate marketing, online courses and coaching, mainstream dating, licensed debt advisory, multi-level marketing.
3.3 Review Tier — Innovatex Specialization
Industries that most providers reject outright, but which IXmail serves under a one-time business review.
Forex brokers and introducing brokers (IBs), proprietary trading firms, crypto exchanges and Web3 platforms, signal services and trading copy services, stock trading platforms, fintech consumer applications, regulated gambling (with license documentation), supplements and CBD products in regulated jurisdictions, sexual wellness products.
Operator review is a one-time call or document exchange establishing the legitimacy of your business and the nature of your sending. It is not a recurring approval gate.
Unlike most providers, we work with fintech and regulated industries — provided you can demonstrate compliance. Operator review is a one-time conversation, not an indefinite wall.
3.4 Prohibited
Categories of sender or content that IXmail will not accept under any circumstances. Accounts identified at signup are rejected; accounts that begin sending Prohibited content after activation are subject to immediate suspension and termination. A complete list of Prohibited content is in Section 6.
4. Compliance with Applicable Law
You agree to comply with all laws applicable to your sending, including but not limited to:
- CAN-SPAM Act (United States)
- CASL (Canada)
- GDPR (European Union)
- UAE PDPL (Federal Decree-Law No. 45 of 2021 on Personal Data Protection)
- Any national or regional spam and electronic communications laws applicable to your Recipients
You are solely responsible for understanding the laws applicable to your Recipients, regardless of where you operate.
5. Consent and Sending Practices
You may send email through IXmail only to Recipients who have a legitimate relationship with you, including:
- Express consent — the Recipient has explicitly opted in to receive the type of mail you are sending.
- Inferred consent — the Recipient has an active commercial or transactional relationship with you (e.g. recent purchase, account holder).
Single opt-in is acceptable for transactional and most commercial mail; double opt-in is strongly recommended for marketing lists.
You may not send to:
- Email addresses purchased, rented, traded, scraped, or otherwise obtained without consent
- Lists imported from a prior provider where you do not have a record of consent
- Recipients who have unsubscribed or marked your previous mail as spam
- Role-based addresses (info@, admin@, abuse@) for marketing purposes
Every marketing message must include:
- A clear, working unsubscribe link
- A valid postal address of the sender
- Accurate "From," "Reply-To," and subject-line information
- One-Click List-Unsubscribe header (RFC 8058) for bulk mail to Gmail and Yahoo
6. Prohibited Content and Activities
You may not use IXmail to send, facilitate, or promote any of the following:
Fraud and Abuse
- Phishing, credential theft, account-takeover services
- Malware, ransomware, or executables distributed without explicit prior recipient consent
- Pump-and-dump schemes; manipulation of equity, commodity, or token markets
- Initial Coin Offering (ICO) or token promotions with no underlying utility, working product, or recognized whitepaper
- "Make money fast," "guaranteed returns," or similar high-yield investment schemes lacking regulatory licensing
- Pyramid schemes; undisclosed multi-level marketing recruitment to non-consenting recipients
Illegal or Unlicensed Activity
- Unlicensed sale or marketing of regulated substances (pharmaceuticals, controlled substances, narcotics)
- Unlicensed sale or marketing of firearms, ammunition, weapons, or weapon parts
- Unlicensed gambling, lotteries, or wagering services
- Counterfeit goods
- Tax evasion services, money laundering, sanctions circumvention
Harmful Content
- Pornography or sexually explicit content (sexual wellness from regulated businesses is permitted under Review Tier)
- Any content involving minors in a sexual or exploitative context — zero tolerance
- Hate speech, harassment, doxxing, threats of violence
- Content promoting self-harm or suicide
Email-System Abuse
- Sending from purchased, rented, or third-party-supplied email lists
- "List washing" services or attempting to clean a poisoned list against our infrastructure
- Re-warming IPs that have been delisted by major blocklists at other providers
- Attempting to circumvent rate limits, suppression lists, complaint handlers, or detection systems
- Operating multiple accounts to evade enforcement actions
7. Authentication and Domain Hygiene
You must complete the following before sending production volume:
- SPF — published TXT record with our SPF include
- DKIM — published DKIM keys provided by IXmail (dual-key signing)
- DMARC — minimum policy of
p=nonewith a validrua=reporting address
Recommended: MTA-STS, TLS-RPT, and BIMI for marketing-heavy senders.
We reserve the right to suspend sending from domains that fail authentication or whose DMARC alignment falls below acceptable thresholds.
8. Sending Limits and Volume Governance
New accounts are subject to a daily sending cap during the first 14 days following activation:
- Standard Tier: 500 messages/day initially, doubling after 7 days of clean history
- Monitored Tier: 200 messages/day initially, doubling after 7 days of clean history
- Review Tier: limits set during operator review, based on declared volume and business type
After day 14, limits are governed by your subscription plan and account-level risk signals.
IXmail enforces these account-level thresholds:
- Hard bounce rate must remain below 5%
- Spam complaint rate must remain below 0.3% (Gmail/Yahoo bulk-sender requirement)
- Unknown-user rate must remain below 5%
Accounts crossing these thresholds will be automatically throttled, paused, or escalated to operator review, depending on severity.
9. Identity Verification (KYC)
IXmail does not require full identity verification at signup. However, we reserve the right to require, at any time, business documentation or formal Know-Your-Customer verification, including but not limited to:
- Requests for dedicated IP allocation
- Volume tier upgrades exceeding 1,000,000 sends per month
- White-label reseller arrangements
- Accounts flagged by abuse monitoring or pattern detection
- Compliance with applicable anti-money-laundering regulations
Failure to provide reasonable verification when requested will result in suspension of sending privileges.
10. Reporting Abuse
We take abuse seriously and respond to all credible reports.
- Abuse complaints: abuse@ixmailer.com
- Phishing and security reports: security@ixmailer.com
- Mailbox-provider complaints (FBL): ingested automatically; complaint headers route to the originating account's suppression list
We respond to abuse reports within 24 hours. Confirmed AUP violations result in the actions described in Section 11.
11. Enforcement Actions
For violations of Sections 4–8 (compliance and sending practices) involving Standard, Monitored, or Review Tier accounts:
- Warning with required corrective action
- Throttling of sending volume pending correction
- Temporary suspension with reinstatement upon proof of remediation
- Permanent termination for repeated or uncorrected violations
For violations of Section 6 (Prohibited Content), regardless of tier, and for all Prohibited Tier accounts:
- Immediate suspension without warning
- Account termination
- Forfeiture of any prepaid balance
- No service credits under any service-level agreement
- Cooperation with law enforcement and regulatory authorities where applicable
We reserve the right to require KYC at any point during this process and to retain account data as required to respond to regulatory inquiries.
12. Right to Modify
We may amend this AUP from time to time to reflect operational, legal, or industry changes. Material changes will be communicated to Customers with at least 30 days' notice via email and in-product notification. Continued use of IXmail after the effective date of an amendment constitutes acceptance of the revised AUP.

13. Governing Law and Jurisdiction
This AUP is governed by the laws of the United Arab Emirates and, in particular, the laws applicable in the Dubai Integrated Economic Zones Authority (DIEZA / IFZA). Disputes arising in connection with this AUP shall be resolved before the courts of competent jurisdiction in Dubai or by arbitration in Dubai, at Innovatex's election.
Note for legal review: confirm whether DIFC courts, Dubai Courts, or DIAC/IFZA arbitration is the preferred forum-selection clause for an IFZA-licensed FZCO.
